Tastes and Tales Food Tours, LLC – Participant Liability Waiver and Release
PLEASE READ CAREFULLY. BY PURCHASING A TICKET OR PARTICIPATING IN THE TOUR, YOU AGREE TO THE FOLLOWING TERMS:
I, the undersigned participant, voluntarily agree to participate in a guided walking food tour (“Tour”) provided by Tastes and Tales Food Tours, LLC (“Company”), a Florida limited liability company.
ACKNOWLEDGMENT OF RISK
I understand that the Tour involves walking outdoors, crossing streets, entering third-party establishments (restaurants, shops, etc.), consuming food and beverages, and other activities that may pose inherent risks. These may include but are not limited to slips, trips, falls, weather conditions, allergic reactions, foodborne illness, or other hazards associated with food tasting and walking in public areas.
I affirm that I am in good health and physically capable of participating in the Tour and voluntarily assume all risks associated with participation. I accept full responsibility for my own safety and the safety of any minor accompanying me.
ALCOHOL POLICY (21+)
I understand that wine or beer samples may be offered during the Tour, either directly by the Company (such as at a gift shop) or by third-party establishments.
I agree that I must be 21 years of age or older to consume alcohol and will provide valid government-issued identification if requested. I understand that participation in alcohol tastings is optional and that I am solely responsible for my alcohol consumption.
The Company reserves the right to refuse alcohol service or remove any participant without refund if they appear intoxicated, impaired, or disruptive. Participants under 21 years of age may attend but are strictly prohibited from consuming alcohol.
RELEASE OF LIABILITY
In consideration of being permitted to participate in the Tour, I hereby release, waive, discharge, and hold harmless Tastes and Tales Food Tours, LLC, its owners, employees, contractors, affiliates, and insurers (collectively, “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, illness, or death that may be sustained by me or my property while participating in the Tour.
This release includes, to the fullest extent permitted by Florida law, any claims arising from the negligence of the Released Parties, and applies to risks associated with walking, food consumption, alcohol consumption, and participation in activities at third-party establishments.
THIRD-PARTY ESTABLISHMENTS
I understand that the Company is not responsible for the operations, services, food preparation, or hygiene practices of any third-party restaurant or venue visited during the Tour. Any issues or claims arising from those establishments must be directed to them.
FOOD ALLERGIES & DIETARY RESTRICTIONS
I acknowledge that I am solely responsible for communicating any food allergies or dietary restrictions to the Company at the time of booking. I understand that the Company cannot guarantee allergen-free environments or accommodations for all dietary needs and assume all risks associated with food consumption.
PHOTO AND MEDIA RELEASE (OPTIONAL)
I understand that photographs or video recordings may be taken during the Tour for marketing and promotional purposes.
Participation is completely optional. If I do not wish to be photographed or recorded, I will inform the Tour guide, and the Company will honor my request and take reasonable steps to ensure I am not included.
If I choose to participate, I grant the Company permission to use my image, likeness, or voice for promotional purposes without compensation.
GUEST CONDUCT
I agree to follow all instructions provided by the Tour guide and to behave respectfully toward other participants, staff, and partner establishments.
The Company reserves the right to remove any participant from the Tour without refund for unsafe, disruptive, or inappropriate behavior, including intoxication.
MINORS
Participants under 18 must be accompanied by a parent or legal guardian, who accepts full responsibility for the minor. Participants under 21 years of age are not permitted to consume alcohol.
GOVERNING LAW
This Release shall be governed by and construed under the laws of the State of Florida. Any legal action shall be brought exclusively in the courts located in Citrus County, Florida.
ACKNOWLEDGMENT & AGREEMENT
By purchasing a ticket or participating in the Tour, I acknowledge that I have read, understand, and voluntarily agree to this Waiver and Release of Liability. This agreement shall be binding upon me and my heirs, successors, and legal representatives.
